I got into an accident that I was told by my insurance company is not my fault but I did not have full coverage on the car so I ended up getting screwed. Now I am taking the other driver to small claims court. I have all the documents for court from my insurance and I am going to make a photo album of the car. Is there anything else I should do? Has anybody had experience with this?

your on the right course...the more of your allegations you can prove or support with notes, documents, pictures, witness's on your behalf or their affidavits the better your chances for success....in most small claims cases, it comes down to which side's the most credible

coverage on your car? And isn't insurance required in California? If so, the cops should be descending on the at-fault driver to take his license plates, drivers license and possibly arrest him. Especially if the other driver was ticketed. Didja talk to the investigating cops?

The way the "required" insurance works in California is:

If you get pulled over for doing 46mph in a 45mph zone at the bottom of a hill with a 60mph tailwind, and the officer finds out that you are not insured, THEN they impound your car, ticket you, and make you walk home barefoot for six miles over broken glass.

If you are hit by another driver who is uninsured, then the outcome is the same for you, minus the ticket.

I hear so many stories about accidents with unisured drivers (and many times un-licensed, and sometimes drunk), and the police just let both parties go their separate ways.

Has anybody done the math to figure out what kind of bond they could afford if they had invested that money instead of paying their car insurance every month?

Make sure that you have the police report. Also while you are at it see if (now this might be along shot) you can either have the investagating officer there as a witness.
