Good news for (some) 76 2002 owners in California

Looks like the CA Senate passed an amendment last Friday, to exempt model year 1976 to 1980 from smog testing:

I have been following this for a few months now, and the hearing last Friday ended with a 7:0 vote. Only catch is that the new law is temporary for 2 years (1/1/17 to 12/31/18), unless they make it permanent, and you have to insure your car as a collector vehicle. Daily drivers might still have to smog their cars.

Thanks for the info.  I will be calling my agent to see what it takes to insure as a "collector" car.  I currently a have a regular policy with a replacement value clause (whatever that means), I have been with State Farm for 30+ years and two total claims and a few minor ones have been handled more than fairly.

I am far from CA and knowing the details of the CA inspection system, but this sounds promising.

 

Just so those of us "beyond the borders" can share in this knowledge, my understanding is that, under the existing regulations, a 1976-or-newer vehicle that is REGISTERED as an historic vehicle may not have been subjected to emissions testing, but this was an ERROR on the part of the CA DMV.  Read the following carefully, including the DMV notice:

And at this point it remains to be seen whether CA will or would begin to test such 1976-and-newer vehicles REGISTERED under the historic vehicle program.

 

But under this amendment passed by the CA Senate, am I to understand that REGISTRATION as a historic vehicle -- whatever that means from an emissions inspection standpoint -- is not required, so long as the car is INSURED as a collector vehicle.  Collector insurance likely permits a broader use of a car than most state antique- or historic-registration regulations, but I suppose we need to see how the new regulations would define collector insurance.  Is the definition as broad as "stated-value" insurance or is it much narrower?

 

I insure the '02's with Hagerty and I believe there is a vague annual mileage limitation: it may even depend on the age of the car, although that seems silly.  Their key criterion seems to be that the car is not a daily driver.

 

Regardless, assuming this amendment is enacted, it's a good sign that someone is actually thinking about collector vehicles in a positive way!

Update:

Law didn't pass, unfortunately. Although the appropriations committee passed  it, the full senate vote resulted in a tie, and a majority was needed. It's put on ice until next year. We were so close.....

Interesting, never knew about that.  i Wonder if they recognize the 2002 as part of the 3 series model or not.   Makes me wonder if i should be picking up an e21 soon :)

I read it twice and what I understand it means is that a car is exempt for the first seven years of existence. IE a 2017 car will need to start biennal inspections in 2024 regardless when it was sold.  That is what I think seven model-years means.
