Was Hoping To Never Need To Do This...

Well. I was really hoping I would never have to post this here but here I am... No, I'm not selling the car! But, about two weeks ago my car was parked at work and a guy pulled his boat trailer into it and killed the driver fender. Luckily the euroweave was turned so he didnt kill that! But the reason I'm posting now is after the adjuster came out his insurance company is trying to total my beloved ol' girl. So any tips, links, etc y'all could provide to help me fight this would be awesome! I plan to send them a copy of NADA Classics, some ebay listing I find, a stack of all the receipts I can find from IE, Blunttech, etc to prove my car is worth something! Thank's guys!

That's an option. I really dont want it to turn into a salvage title though. I plan to talk to the agent about it tomorrow and see what they say.

why would they total if for a fender?  that is a pretty simple repair.  do they have the car valued correctly?

Exactly my point! I gotta figure out all the value stuff with em tomorrow...

 

My title never changed. They just gave me a check. And I gave the cash back and drove away in my BMW.

Well that's not horrible then.

Its through his insurance which is USAA. I plan to send em NADA first thing.

His insurance company just wants to make this a quick settlement and be done with it. I'd have your own insurance company come out and look at it. Tell them you don't want a salvage title, and are willing to take a settlement less projected salvage in order to not deal with that. Your insurance will collect back from USAA and since it's not your fault, your rates won't increase. This supposes that you have full coverage though.

I've never had a problem dealing with USAA on my 2002s, both for comprehensive and collision (other guy's fault).  Their adjusters--at least here in Dayton near a major AFB--are pretty savvy about older cars and never gave me a problem after encounters with a coyote, truck tire chunks and rocks flung up by trucks. 

 

I didn't get much of a hassle from State Farm when one of their insureds backed into my '69; had to have a come-to-Jesus meeting with their head adjuster, but my body shop and the field adjuster straightened everything out to my satisfaction.

 

IIRC that fender is about $400, parking light about $75 and the side marker about $20, plus labor to install and paint--total bill shouldn't be more than a grand, and your car is worth a lot more than that.  Keep after 'em; you can outwait 'em since the car's still driveable....

I just had my brother back a trailer into the front left fender of my daughter's '76. When looking into the repairs I was a little taken back at the cost of parts. If and I say if you want OE parts they are a bit more expensive but available. Of course this car is her pride and joy and she wants a new OE fender replacement which made me swallow a little hard, but I had the other part in my inventory of things so what the heck right?. Haven't gotten much of a settlement out of big brother yet because he insisted that it not be turned into the insurance company. So the lessons learned for me in this whole deal is never park your car in plan site because someone will hit it, and when it come's to insurance dealings, never listen to family and let them cut corners in repairing your car. Sometimes you just have to keep your humor about you.

Read your insurance policy carefully.  It most likely values the car at "market value" and this is a legal contract with insurance company but the policy may have limits or exclusions for antique/collectible cars.  Depending on what that fine print says your insurance company will have to pay fair market value - not some amount they feel is appropriate.  Photos, recent sales, etc. will help determine the value.

 

If you're not satisfied ask your insurance company for the information they used to determine their value.  Show them your supporting information and tell the you'll go through litigation if you can't reach an agreement.
