On April 22nd, I sold an E21 sun visor to a certain customer who advertises regulary on 2002 FAQ and who shall remain nameless for the moment. A few weeks later, this customer sent a cheque for the full amount of $20.07 (actually for more than the full amount - $28.00 - of his own volition - quite nice) - but, my name was misspelled on the cheque. Having cashed enough personal cheques at my bank to know they would never accept such a cheque, I immediately emailed the customer, pointing out that he had both overpaid me and misspelled my name, making the cheque uncashable in my opinion. I tore the cheque into pieces, sent him a photo of this torn-up cheque to prove that I wasn't trying to "double-bill" him and asked for a replacement cheque. His rather vague response left me with the impression that a replacement cheque was on its way.
Two weeks go by - no replacement cheque arrives - I send a polite email asking for an explanation - no response to the email. Four days later, I send the same email - once again, no response. So today I sent a new email, admittedly a bit more aggressive in tone, asking him to provide a legitimate reason why I hadn't received payment yet. He finally responded to this email by simply saying the cheque would be in the mail the next day. I responded by saying that was a good thing, as I was about to go public with this grievance if he had failed to respond to a third email in a row. End of story, I thought.
Now, he's got something sizeable up his butt, demanding that:
a) I mail him back the torn-up cheque (as if photographic proof isn't good enough?) as well as an official document from my bank verifying that they would not accept the original cheque (which was torn-up 3 weeks ago) because of the misspelled name
b) I mail him $35.00! to cover what he claims to be his bank's service fee for stopping payment on a cheque, a fee which, strangely enough, he made absolutely no mention of before when I first asked him for a replacement cheque. $35.00 to stop payment on a cheque - who is he dealing with - the Bank of Corleone?!?!?
Then and only then will he send me my cheque for $20.07.
I tried phoning him twice tonight to try and resolve this like normal adults - twice, he hid behind his answering machine.
Some of you out there may have done business with me in the past, and can hopefully vouch for the fact that I run an honest operation selling good quality parts to fellow BMW enthusiasts at decent prices. So tell me - am I the one at fault in this matter???
What say you, Wise Elders of the 2002 - thumbs up or thumbs down on this unnamed customer??? I await your ruling.....

Ian: Sometimes people get busy in life. Bill may have had a bunch of crap going on, and losing $20 for a few weeks shouldn't land you in the poorhouse. Cut the guy some slack, take a deep breath, and chill the hell out. You'll get your money in enough time; Bill didn't get to be as reputable person as he is by stiffing people out of their money. If he did, we'd have heard about it by now.
Bill: Digging your heels in here is just going to piss off Ian more. Write a new check, maybe even type it out so there is no mistaking bad penmanship for the wrong letter, and then never do business with one another again if you all think its so much of a hassle. Yeah, "Going Public" seems like a silly threat, but at the same time, its just $20.
My shipments and payments have been slow in the past. I forgot to mail Bill a check for $175 for like 3 weeks after he sent me my kickpanels, and he never even twitched about it. It'll all come out in the wash, and life is too damn short to get your panties all twisted over silly crap like this. _________________

I have dealed many times with Ian and HE IS A VERY TRUSTABLE PERSON.

Guilty as charged on the overpay and mis-pell, he did e-mail me and with a speed bump in our family's life right now, I was not responsive, no excuse, just the fact.
Now the difference is, he e-mailed again me to remind me of my tardiness a couple nights ago, I responded to the e-mail, "Check in the mail tomorrow", I even had it written out.
Then he e-mails me back to that he needed a reason for my tardiness and he was going public. That POed me after I had committed to make the payment with an L.
About hiding behind the answering machine, I had just left to go back to the hospital with our pet. Be careful about making accusations when you have no idea what is going on Ian.
So I get pissy and asked him to return my first check or pay the stopped payment fee which my bank does charge, that is easier to believe than a bank will not cash a customer's check minus an L.
So, that is where we stand, when I get the torn up check back or the payment for stopped check, his check will be in the mail the same day. _________________ 1972 2000tii Touring

Thank you for the above input. I concede victory to Mr. Williams - he was right, I was wrong. I've already put his torn-up cheque, his bank's $35.00 cheque-stop-payment service fee and a card of apology in the mail. Hopefully, this will be sufficient to put this matter to rest.

Ian,
Your stock just rose substantially in my book. Those words are some of the hardest to say, even on a public forum. Taking responsibility for your own actions is huge no matter what the other person did or did not do.
I now regret advising you to take a valium. : )
