Subject: Update and advice needed on the eric is screwed situation


So my insurance company can do nothing for me anymore. But they have told me not to accept any blame at all. and the other insurance company(progressive) is not picking up nor returning any of my phone calls starting two weeks ago. I do however have their address and it is on the other side of the city(SF). I am going to show up in person so there is no way that they can avoid me but I do not know what to bring. I am thinking that a folder with every picture that I have of the car would be a good thing to bring anything else? Also, what should I say to them? I know be polite but....I will try my best

Write them a formal letter explianing your situation and tell them have 10 business days to get this resolved or you will report them to the Department of Insurance. Send it certified mail with return receipt so you know when they got it. If nothing has been done after 10 days report them and call to let them know they have been reported.

This is what I was told when I was going through something similar when my 02 got totaled. Appearantly Ins. companies don't like being reported and will get things done to avoid it.

but the Department of Insurance only has jurisdiction involving matters between a carrier and a policy holder, but in this case Eric is only a potential property damage claimant and not insured with Progressive. If Eric has a police report or a written statement from the other party, he can forward that to Progressive (certified letter), if not the chances for success are very slim...

in Cal, I'll try and advise you on what to do. I'll need the incident, responsibility and what you've done to date. Maybe a duber for the chairman of Progressive (he was busted for hemp in New Zealand some years back) might help. I wonder how our faqer from Orange County has progressed with his problem with Progressive and the lack of UMPD on his policy?

establish fault first. Then they want to settle and close the books as much as you do. If their insured is denying fault, you must start there. The car is totaled, so forget cost of repair and concentrate on value of car at the time of loss.
You want them to admit fault, and send a claims adjuster. The car wants to look as if it were perfect at the time of loss. Don't remove parts or make repairs until it's adjusted. Most of the adjusters I worked with were reasonable if the car or shop owner was the same. Most of those who are not reasonable work for AAA.

Subject: Last time I had to deal with this sort of situation, I took every

reciept I could find and the best pre-damage photos I had over to Kinko's and made two copies of everything (one reciept to a page), three hole punched everything, and put each set of copies in an inexpensive binder (one for me, one for them) with the photos in front and the reciepts in chronological order.

Assuming you've done a fair amount of work (both improvements and maintenance) to the car over the time you've had it, having all your documentation neatly organized in a binder makes it easy to present your value justification, and having each reciept on a separate page bulks up the content and shows that you've been consistant in maintaining and improving the car.
